Terms & Conditions

These Terms & Conditions apply to bookings made with Vale’s Rambo Adventures (“we,” “us,” or “our”) for kayaking, snorkeling, sightseeing, and related tour experiences in Aruba.

By booking, joining, or participating in any of our tours or services, you confirm that you have read, understood, and agreed to these Terms & Conditions.

1. Booking and Payment

All bookings are subject to availability and are only confirmed once payment has been received or otherwise approved by us in writing.

We reserve the right to refuse or cancel a booking where necessary for safety, operational, legal, or business reasons.

Prices are displayed in the applicable currency shown at the time of booking. Any taxes, fees, or charges shown during booking form part of the total amount payable.

2. Tour Participation

Participants are responsible for ensuring that they are physically able to join the selected activity.

By joining a tour, each participant confirms that they:

  • are in suitable physical condition for the activity booked

  • will follow all safety instructions given by the guide

  • will use equipment in a responsible manner

  • will inform us in advance of any relevant medical condition, injury, or limitation that may affect participation

Children must be accompanied by a responsible adult unless expressly agreed otherwise by us in writing.

We reserve the right to deny participation, without refund where appropriate, if a participant appears intoxicated, behaves dangerously, refuses to follow instructions, or is otherwise not fit to safely join the activity.

3. Safety and Operational Authority

Safety is our priority. Our guides and management retain full discretion to make decisions relating to weather conditions, sea conditions, route adjustments, launch points, timing, group management, and whether a tour should proceed.

We may delay, shorten, modify, reschedule, or cancel a tour where necessary due to:

  • weather conditions

  • sea conditions

  • safety concerns

  • equipment issues

  • government or regulatory instructions

  • other circumstances beyond our reasonable control

These decisions are final and are made in the interest of guest and staff safety.

4. Arrival and Check-In

Guests are responsible for arriving on time at the designated meeting point.

Please arrive at least 15 minutes before the scheduled start time unless a different check-in time is communicated to you.

Late arrivals may miss the tour. If a guest fails to arrive on time and the tour departs without them, this may be treated as a no-show and may be non-refundable.

5. Cancellations by Guests

Unless otherwise stated in writing at the time of booking:

  • cancellations made more than 24 hours before the scheduled start time may be eligible for a refund or rescheduling

  • cancellations made within 24 hours of the scheduled start time may be non-refundable

  • no-shows are non-refundable

Where third-party platforms, agents, resellers, hotels, or online travel agencies are involved, their cancellation terms may also apply. In such cases, the applicable booking channel’s rules may govern the refund process.

6. Cancellations or Changes by Us

If we cancel a tour due to unsafe conditions, operational reasons, or circumstances beyond our control, we may offer one of the following at our discretion:

  • rescheduling to another available date or time

  • a credit

  • a partial or full refund, depending on the circumstances and booking channel used

We are not responsible for additional costs incurred by guests, including transportation, accommodation, lost time, missed connections, or other indirect expenses.

7. Weather and Sea Conditions

Outdoor and marine activities are dependent on weather and sea conditions. Light rain, wind, currents, or changing water conditions do not automatically mean a tour will be canceled.

All final decisions regarding whether conditions are suitable for operation are made by us.

8. Equipment and Guest Responsibility

Any equipment provided by us must be used carefully and only as instructed.

Guests may be held responsible for loss or damage caused by misuse, negligence, or failure to follow instructions.

Guests are also responsible for their personal items, including phones, cameras, wallets, sunglasses, jewelry, and other valuables. We are not liable for loss, theft, or water damage to personal belongings.

9. Assumption of Risk

Participation in outdoor and water-based activities involves inherent risks, including but not limited to:

  • slipping

  • falling

  • sun exposure

  • dehydration

  • sea and weather conditions

  • contact with marine life

  • equipment-related incidents

  • physical exertion

By participating, guests acknowledge and accept these risks.

10. Liability Limitation

To the fullest extent permitted by law, Vale’s Rambo Adventures, its owners, guides, staff, contractors, and representatives shall not be liable for any loss, injury, damage, delay, accident, expense, or inconvenience arising from:

  • participation in a tour or activity

  • natural conditions or events beyond our control

  • acts or omissions of participants or third parties

  • loss or damage to personal belongings

Nothing in these Terms excludes liability where such exclusion is not permitted by applicable law.

11. Photos and Media

We may occasionally take photos or videos during tours for promotional, marketing, and social media purposes.

By participating, you grant us permission to use such material in which you may appear, unless you notify us in advance in writing that you do not wish to be photographed or recorded.

12. Third-Party Bookings

If your booking is made through a hotel, travel advisor, online platform, reseller, or other third party, additional terms from that party may apply.

We are not responsible for errors in pricing, descriptions, schedules, or promises made by third parties unless confirmed directly by us in writing.

13. Governing Law

These Terms & Conditions shall be governed by the laws applicable in Aruba.

Any dispute arising in connection with our services shall be subject to the applicable jurisdiction of the competent courts of Aruba, unless otherwise required by law.
